Contract for Hotel Bookings
When a booking is completed by you either via our online booking form, an email request or verbally, NuBreed Hotels in its role as agent will arrange for the Client to enter into a contract with the Supplier of the accommodation.
As an agent, NuBreed Hotels accepts no responsibility for the provision of the Hotel Accommodation or for the acts or omissions of the Supplier. The Suppliers terms and conditions will apply to all bookings and the Client should read these carefully. NuBreed Hotels will be able to provide copies of such terms and conditions, where applicable, upon request.
Changes or Cancellation to the Hotel Booking by you:
If you wish to cancel or amend the booking, or any part of them, you must advise NBH accordingly, using the specific contact details provided for notification of changes/cancellations. All changes/cancellations require a cancellation of the original booking and a new booking will be made.
Cancellations can only be accepted in accordance with the terms and conditions of the Supplier concerned and the Supplier may charge the cancellation or amendment charge showing in their terms and conditions (which may be 100% of the cost of the Travel Arrangements). It is your responsibility to pay any such cancellation charges as applied by the Supplier.
For no-shows or early check-outs, the accommodation establishment may charge the full amount of the original booking, in which case reimbursement to the end consumer shall not apply.
Changes or Cancellation to the Hotel Bookings by the Supplier
NuBreed Hotels will inform you of any changes or cancellations made to the Hotel Booking by the Supplier as soon as reasonably possible after NuBreed Hotels becomes aware of such.
If, as part of any such amended or cancelled Hotel Booking, the Supplier offers alternative arrangements or a refund, you must let NuBreed Hotels know whether you wish to accept the alternative arrangements within the time frame NuBreed Hotels stipulate. If you fail to do so the Supplier is entitled to assume that you accept the cancellation and wish to receive a full refund.
NuBreed Hotels accepts no liability for any changes or cancellations made to any Hotel Bookings by the Supplier.
Bookings may be cancelled by request of either Party with no penalty whatsoever in a Force Majeure event (as defined in this Agreement), which may affect the various destinations and, specifically, the location of the accommodation establishment at destination, as well as the country of origin of the end consumers.
NuBreed Hotels Responsibility for the Services
Your contract for the actual provision of the Hotel Accommodation is with the Supplier and its terms and conditions apply.
As agent, NuBreed Hotels accepts no responsibility for the actual provision of the Hotel Accommodation.
NuBreed Hotels accepts no responsibility for any information about the Hotel Accommodation that it passes on to you in good faith. However, in the event that NuBreed Hotels are found liable to you for any reason whatsoever, NuBreed Hotels total aggregate liability to you in respect of any claim or series of claims will not exceed the value of the goods and/or services contracted for.
NuBreed Hotels Obligations:
Once NuBreed Hotels received your booking and all appropriate payments, NuBreed Hotels will confirm by issuing a confirmation e-mail containing a booking voucher including the booking reference.
You shall carefully check the dates, the price, guest details, the destination and the accommodation supplier details before completing any booking. Information relating to the cancellations policy, costs and details applicable to the booking will also be displayed during this process.
You must take your booking confirmation number with you to your chosen accommodation. If you experience booking difficulties at any time, please contact NuBreed Hotels via our customer support email email@example.com
You will be liable for the acts and omissions of any bookings. In this case, NuBreed Hotels and/or the Accommodation supplier reserve the right to automatically cancel end consumer bookings with no right of the end consumer to any compensation whatsoever.
Financial & Payment Terms
Unless expressly indicated, prices quoted including all indirect taxes will be payable at the time of booking.
Any tourist/stay tax, will be payable by you, to the hotel;
You are responsible for paying, in full, all sums payable to the Supplier for the Hotel Accommodation booked. If full payment of such sums is not received at the time of booking, NuBreed Hotels will notify the Supplier who may cancel your booking and charge the cancellation fees set out in the Suppliers terms and conditions.
Any and all monies paid to NuBreed Hotels, which are duly payable to the Supplier of the Hotel Accommodation in accordance with this Agreement are held by NuBreed Hotels on your behalf until they are paid to the Supplier.
If the Client is unsure as to the cancellation and/or refund provisions of any particular booking or the charges levied by a Supplier then clarification should be sought from NuBreed Hotels at the time of booking.
Since the contract for the provision of the Hotel Accommodation is between you and the Supplier, and any queries or concerns should be addressed directly to the Supplier.
If you have a problem with the provision of the Hotel Accommodation, this must be reported to the Supplier immediately. If you fail to follow this procedure there will be less opportunity to investigate and rectify its complaint.
NuBreed Hotels in its role as agent can assist you in addressing any complaints that you may have to the Supplier either before, during or after your stay. Should you require such assistance, you should contact NuBreed Hotels using the specific contact details provided.
Neither Party shall be liable to the other for failure to perform any of the duties or obligations required of such Party herein in the event of strikes, lockouts, calamities, acts of God, unavailability of supplies or other events over which such Party has no control for so long as such event continues and for a reasonable period of time thereafter (a “Force Majeure Event”). In such Force Majeure Event, the performance times shall be excused for a period of time equivalent to the time lost because of the excusable delay. However, if an excusable delay continues more than thirty (30) consecutive calendar days, the Party not relying on the excusable delay may, at its option (and without penalty or financial obligation of any kind), terminate this Agreement upon notice to the other Party. In order to avail itself of the relief provided in this Section from an excusable delay, the Party must act diligently to remedy the cause of, or to mitigate or overcome such delay or failure. For avoidance of doubt, an increase in costs shall not be a Force Majeure Event for this Agreement.
In case of early termination due to Force Majeure Event, all deposits will be returned, less any Expenses and/or Fees that have already been incurred in connection with the provision of services pursuant to this Agreement and are not recoverable by NuBreedHotels. In case the original booking cannot be fully utilized due to the Force Majeure Event NuBreed Hotels will reimburse the part of the booking that was not used at a later stage after the event. NuBreed Hotels will not be responsible for the costs of any new accommodation offered to the final customer should a Force Majeure Event occur at the destination. For this clause, “Expenses” means any monetary outlay that cannot be recovered by NuBreed Hotels including deposits already paid to third party suppliers which may not be refundable under their contractual terms and conditions; and “Fees” means any payment due to NuBreee Hotels for services rendered, including but not limited to NuBreed Hotels administrative/management fees, before the early termination due to Force Majeure Event. Such termination due to a Force Majeure Event shall be without prejudice to the rights of the Parties in respect of any breach of this agreement occurring prior to such termination.
